evian x Snoopy Contest Terms and Conditions

Introduction

By participating in the Contest, the Participants agree to be bound by the following terms and conditions and all amendments, additions and modifications as may be made from time to time by the Organiser, at its sole discretion. Participants agree that their continued participation in the Contest constitute their unconditional acceptance of the amended Terms and Conditions.

Terms and Conditions

  1. The evian x Snoopy Contest (“Contest”) is organised by GBA Corporation Sdn. Bhd. (Company No. 162820-U) (“Organiser”).
  2. The Contest is open to all individual Malaysian citizens and permanent residents, with valid identification documents, aged 18 and above (as of 1st June 2023), except employees and their immediate families of the Organiser and its affiliated companies.
  3. Contest Period: From 1st June 2023 12:00:00 AM to 31st July 2023 11:59:59 PM Malaysian time.
  4. Participating Products: evian Natural Mineral Water and evian Sparkling Carbonated Natural Spring Water range of products.
  5. To participate:
    1. Step 1: Purchase RM18 worth of the Participating Products inclusive of one (1) evian x Snoopy Limited Edition 500ml in a single receipt (“POP/Proof of Purchase”) at any retail stores/supermarkets or online stores/marketplace vendors in Malaysia to be eligible to enter the Contest.
    2. Step 2: Scan QR code or visit https://guppyrock.com/contest/evianxsnoopy/ and submit the required details as follow:
      1. Name as per NRIC, new NRIC number, WhatsApp mobile phone number.
        • Example: Nik Rose, 890917075110, +6012-3456789
      2. Attach a clear photo of the receipt (“POP”) taken with at least one (1) evian x Snoopy Limited Edition 500ml.
        1. Please ensure the following details are clearly visible in the photo of the receipt:
          • evian x Snoopy Limited Edition 500ml
          • Name of retail store/supermarket or online store/marketplace vendor.
          • Purchase date.
          • Receipt number.
          • Participating Products purchased.
          • Amount spent on Participating Product purchased.
  6. The Organiser has the sole and absolute right as it deems fit and necessary to amend the Contest Period, the Contest mechanics, to terminate, cancel or suspend the Contest at any time without prior notice.
  7. Participants may submit as many entries as they wish but each entry must be supported with the required Proof of Purchase within the Contest Period. However, only one (1) prize will be awarded per Participant (identified by NRIC number), per Contest.
  8. Proof of Purchase with the dates before or after the Contest Period will not be accepted.
  9. Only entries with original receipts of the correct product purchased are accepted. No handwritten receipt, photocopy of receipt and/or duplicate copy of receipts are accepted. If found, such entry will be forfeited automatically.
  10. Any entries received before or after the Contest Period will be disqualified.
  11. The Organiser reserves the right to disqualify any entry if the Organiser discovers that:
    1. the Participant had submitted a similar receipt with other entries.
    2. if the entry is incomplete, wrong, spoilt, late or submitted without the Proof of Purchase.
    3. if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
  12. Entries that do not comply with the Terms and Conditions that are enforced will be disqualified automatically.
  13. The Organiser reserves the right to demand for the return of the Prize or payment of its value from the disqualified Eligible Winner in the event of a disqualification after a Prize has been awarded.
  14. Eligible Winners will be selected from all qualified entries received within the Contest Period. The Eligible Winners of the Contest will be selected by the Organiser using the “Division by Sum” method:
    1. Each qualified entry will be allocated a serial number.
    2. The total serial number allocated throughout the Contest Period will be divided by eighty (80) to determine the serial numbers selected as winners (“Eligible Winners”).
    3. Each selected winner entry will be allocated a new serial number. The total winners serial number allocated will be divided by ten (10) to determine the Grand Prize Winners.
    4. The remaining selected winner entries will be allocated a new serial number. The total new serial number allocated will be divided by twenty (20) to determine the Second Prize Winners.
    5. The balance selected winner entries will be the Consolation Prize Winners.
  15. Eighty (80) Eligible Winners determined by the Organiser will be awarded:
    1. Grand Prize: evian x Snoopy Limited Edition chiller – ten (10) winners
    2. Second Prize: evian x Snoopy Limited Edition skateboard – twenty (20) winners
    3. Consolation Prize: evian x Snoopy Limited Edition bag – fifty (50) winners.
  16. Prizes are not transferable or exchangeable for cash, in part or in full. The Organiser reserves the right to substitute the prize with that of a similar value at any time without notice.
  17. The List of Eligible Winners will be announced at https://guppyrock.com/contest/evianxsnoopy/ by 30th August 2023.
  18. Eligible Winners will be contacted via WhatsApp based on the contact details provided upon entry submission on best effort basis with maximum of three (3) attempts. In the event where an Eligible Winner could not be contacted, the Organiser reserves the rights to replace the Eligible Winner with the next name on the list.
  19. Eligible Winner may be required to submit a clear and legible photo of his/her NRIC (only the left section – clearly showing the NRIC number, full name and address; photo of scanned/printed copy will not be accepted), their postal address together with their Proof of Purchase for verification purposes via post or WhatsApp within seven (7) days from the date of notification.
  20. All Proof of Purchases submitted for this Contest will be the property of the Organiser.
  21. Any prize not taken up for any reason within seven (7) days of notification will be forfeited. All appeals thereafter will not be entertained.
  22. The prize will be delivered to the Eligible Winner via courier within sixty (60) days upon Eligible Winner’s identity verification.
  23. The Organiser may extend the timelines and methods of delivery of the Prizes at their discretion.
  24. The Organiser shall not be liable for any loss or damage that occurs to the prizes during the delivery process.
  25. No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted.
  26. By participating in this Contest, Participants agree and are deemed to have consented and given the Organiser the rights to collect and process Participant’s personal data and information for the purposes of this Contest, to publish and/or display particulars, personal data and/or photos of Eligible Winners in print media and electronic media of any forms (as applicable) for the purpose of advertising, publicity and announcement without any royalty and/or compensation.
  27. Any expenses that are incurred to participate in this Contest, to claim the prizes and/or to attend ceremony, is the sole responsibility of the Eligible Winners, without any reimbursements by the Organiser.
  28. Participants agree to bear full liability and responsibility for any loss, injury, damage, costs, expenses, claim or accident suffered, incurred or caused by their participation in this Contest. The Organiser shall not be liable to Participants for any damages, costs, expenses, claims, losses, accidents or inconvenience for any matter arising out of or in connection with this Contest. Each Participant agrees to indemnify and hold the Organiser harmless from and against any and all claims, damage, losses, costs or expenses suffered or incurred by the Organiser in relation to this Contest as a result of any act and/or omission of the Participant.
  29. The Organiser shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever.
  30. Proof of submitting will not be accepted as proof of receipt.
  31. The Participant’s participation in the Contest shall be at the Participant’s own risk.
  32. The Organiser shall not be responsible for the failure of any technical element relating to this Contest that may result in an entry not being successfully submitted. The Organiser shall not accept any responsibility for entries lost, damaged, or delayed because of any network, computer or cell phone hardware or software failure of any kind.
  33. The Organiser may transfer personal data and information of Participants (including but not limited to, name, address, contact numbers, NRIC numbers) to service provider(s) for the purposes of administering the Contest and contacting Participants, solely for this Contest only. Participant has the right to obtain access, request correction or withdraw consent to disclose any personal data and information held by the Organiser.   34. In the event any contests involve merchants, the relevant participating merchant’s reserves the right to revise its terms and conditions without prior notice. The Participants’ entry in the relevant contest shall be further subjected to the participating merchant’s terms and conditions. The Participants shall not be entitled to assign any of the rights or sub-contract any of the obligations herein.
  35. In the event of any inconsistency between these terms and conditions and any other form of publicity collaterals relating to this Contest, these terms and conditions shall prevail.
  36. This Contest Terms and Conditions is available in English version only.
  37. These terms and conditions shall be construed and governed in accordance with the laws of Malaysia. The Organiser and Participants agree to submit to the exclusive jurisdiction of the courts of Malaysia.
  38. The Organiser’s decision on all matters in relation to this Contest are final, conclusive and binding on all Participants of this Contest, and no correspondence, communication or appeals will be entertained.
  39. The Organiser reserves the right to amend the Contest Terms and Conditions without prior notice and no claim shall be made against the Organiser with respect to such amendments.
